  1. Scope and acceptance

These Terms of Sale govern purchases of physical clothing and accessories made by consumers through the Website.

They do not govern wholesale or other business-to-business transactions, which may be subject to separate written terms.

The Terms of Sale applicable to an order are those displayed on the Website when the order is placed. Before completing an order, the customer can review these terms and must accept them as part of the checkout process.

Commune Des Vagues may update these Terms of Sale for future orders. Changes do not apply retrospectively to orders already confirmed.

  1. Products

The essential characteristics of each product—including its description, available sizes, materials, colour and price—are presented on its product page.

Customers should review the product description and size information before ordering. Anyone uncertain about sizing, fit, fabric, colour or another product characteristic is encouraged to contact support@communedesvagues.com before placing an order.

Commune Des Vagues takes reasonable care to present products accurately. However, colours may appear slightly different depending on the customer’s screen, lighting and display settings. Such minor display differences do not affect the customer’s statutory rights where a product does not conform to its description.

Products are offered subject to availability. If a product becomes unavailable after an order is placed, Commune Des Vagues will inform the customer promptly and refund the amount paid for the unavailable product using the original payment method.

  1. Prices, currencies, taxes and import charges

Prices are displayed in the currency applicable to the customer’s selected market. The final product price, applicable taxes, shipping charges and any duties or import taxes collected by Commune Des Vagues are shown during checkout before the customer confirms payment.

Prices may be changed at any time, but an order is charged at the price displayed when it is confirmed, except where an obvious pricing or technical error has occurred. If such an error is identified, Commune Des Vagues will contact the customer before dispatch and offer the choice of confirming the order at the correct price or receiving a full refund.

A customer’s bank or payment provider may charge currency-conversion or international-payment fees. Such third-party charges are not controlled by Commune Des Vagues.

For United Kingdom orders, the checkout is configured to collect applicable UK VAT and, where relevant, import duties. Eligible UK orders are shipped using a Delivered Duty Paid service so that amounts collected at checkout are not requested again upon delivery. Preferential tariff treatment may depend on accurate product origin and customs information.

For other international destinations, the treatment of taxes and duties is displayed at checkout where available and described in the Shipping and Delivery Policy. The customer should review the final checkout total before placing the order.

  1. Orders and formation of the contract

The customer selects products, adds them to the cart and proceeds through checkout. Before payment, the customer can review and correct the selected products, quantities, delivery details and other order information.

The customer is responsible for providing complete and accurate billing, delivery and contact information.

Submitting an order constitutes an offer to purchase. After submission, the customer receives an order acknowledgement by email. The sales contract is formed when Commune Des Vagues confirms acceptance of the order or dispatches it, whichever occurs first.

Commune Des Vagues may decline or cancel an order for a legitimate reason, including:

  • Product unavailability;

  • An inability to authorise payment;

  • An obvious pricing or product-information error;

  • Reasonable evidence of fraud, misuse or an order intended for unauthorised resale;

  • A legal or regulatory restriction preventing fulfilment; or

  • An inability to deliver to the supplied address.

If payment has already been collected for an order that is declined or cancelled, the affected amount will be refunded using the original payment method.

The order confirmation and these Terms of Sale form the contract between the customer and Commune Des Vagues.

  1. Payment

Payment is due when the order is placed. Available payment methods are displayed at checkout and may vary by country, currency or device.

Payments are processed through Shopify and the payment providers displayed at checkout. Commune Des Vagues does not receive or store the customer’s complete payment-card details.

Ownership of the products remains with Commune Des Vagues until full payment has been received. Risk of loss or damage passes to the consumer when the consumer, or a third party designated by the consumer other than the carrier, takes physical possession of the products.

  1. Order processing and delivery

Orders are normally prepared for dispatch within one to three working days after confirmation. Working days are Monday through Friday, excluding public holidays in France.

Available destinations, carriers, delivery methods, prices and estimated delivery periods are described in the Shipping and Delivery Policy and displayed at checkout. Depending on the destination, Commune Des Vagues currently uses Mondial Relay, DHL Express and other stated delivery services.

Current estimated carrier transit periods include:

  • Mondial Relay destinations: up to 10 working days;

  • DHL international destinations: up to 7 working days; and

  • United Kingdom DHL Express: 3 to 5 working days.

These carrier transit periods begin after dispatch and are separate from the one-to-three-working-day order-processing period.

For the United Kingdom, the current shipping rates are:

  • Orders below £135: £25 DHL Express shipping; and

  • Orders of £135 or more: free DHL Express shipping.

For the European Union, free standard shipping is currently available on qualifying orders of €75 or more. For the United States, free shipping is currently available on qualifying orders of $150 or more. The rates and thresholds displayed at checkout for the selected market prevail.

The delivery period communicated during checkout or in the order confirmation is part of the contract. If no delivery date or period is agreed, delivery will occur without undue delay and no later than 30 days after the contract is concluded, except where legally permitted circumstances apply.

The customer must provide a complete and accurate delivery address. If a parcel cannot be delivered because the customer supplied an incorrect or incomplete address, failed to collect it, or refused it without a legally valid reason, Commune Des Vagues may require payment of reasonable additional delivery costs before resending it. This does not limit the customer’s statutory rights.

If delivery is delayed, lost or damaged, the customer should contact support@communedesvagues.com promptly. The customer may also report visible transport damage to the carrier, but failure to do so does not remove the customer’s statutory rights against Commune Des Vagues.

  1. Voluntary returns and exchanges

In addition to statutory rights, Commune Des Vagues offers a voluntary return period of 30 calendar days from delivery for eligible products.

For a change-of-mind return under this voluntary policy:

  • The customer must contact Commune Des Vagues before returning the product;

  • The product must be unworn, unwashed and unused, with its original tags and, where reasonably possible, its original packaging;

  • The customer is responsible for the direct return-shipping cost; and

  • The customer should retain proof of postage until the return has been completed.

Products may be handled only to the extent reasonably necessary to establish their nature, characteristics and fit. Commune Des Vagues may apply a legally permitted deduction for diminished value caused by handling beyond what would be acceptable in a physical shop.

Where an incorrect, damaged or non-conforming product has been supplied, Commune Des Vagues will bear the necessary return costs and the customer’s statutory guarantee rights apply.

Customers must not return products without first requesting return instructions from support@communedesvagues.com. The business address in these Terms of Sale is not necessarily the authorised return address.

  1. Statutory right of withdrawal

Consumers in the European Union and European Economic Area generally have the right to withdraw from an online purchase without giving a reason within 14 calendar days from the day on which the consumer, or a third party designated by the consumer other than the carrier, takes physical possession of the product.

For an order containing several products delivered separately, the period begins when the last product is received.

To exercise the right of withdrawal, the consumer must send an unambiguous statement before the withdrawal period expires. The consumer may use the model form at the end of these Terms of Sale, but its use is not mandatory.

The consumer must return the products without undue delay and no later than 14 days after communicating the withdrawal decision. The consumer bears the direct cost of returning the products unless Commune Des Vagues agrees otherwise or the products are faulty, damaged, incorrect or non-conforming.

Following a valid withdrawal, Commune Des Vagues will reimburse all payments received for the withdrawn products, including the cost of the least expensive standard delivery method offered for the complete order. Any additional amount paid for an enhanced or express delivery option is not reimbursed beyond the standard-delivery amount.

Where only part of an order is returned, the original delivery cost is not refunded if it would have been charged at the same amount for the retained products.

Reimbursement will be made without undue delay and no later than 14 days after Commune Des Vagues is informed of the withdrawal. Commune Des Vagues may withhold reimbursement until the returned products are received or until the consumer supplies evidence that they have been sent, whichever occurs first.

Reimbursement will be made using the original payment method unless the consumer expressly agrees otherwise, and no reimbursement fee will be charged.

The consumer is responsible only for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the products.

Nothing in the voluntary 30-day return policy reduces the statutory 14-day right of withdrawal.

LEGAL GUARANTEE OF CONFORMITY

The consumer has two years from delivery of the product to invoke the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer is required to establish only the existence of the lack of conformity and not the date on which it arose.

The legal guarantee of conformity gives the consumer the right to repair or replacement within 30 days of the request, free of charge and without major inconvenience.

If a product is repaired under the legal guarantee of conformity, the original guarantee period is extended by six months.

If the consumer requests repair but the seller requires replacement, the legal guarantee is renewed for two years from the date the replacement product is delivered.

The consumer may retain the product and obtain a price reduction, or terminate the contract and receive a full refund against return of the product, where:

  • The seller refuses to repair or replace it;

  • Repair or replacement does not occur within 30 days;

  • Repair or replacement causes major inconvenience to the consumer;

  • The lack of conformity remains after an unsuccessful attempt to bring the product into conformity; or

  • The lack of conformity is sufficiently serious to justify an immediate price reduction or termination.

The consumer is not entitled to terminate the sale where the lack of conformity is minor.

Any period during which the product is unavailable for repair or replacement suspends the remaining guarantee period until the restored or replacement product is delivered.

These rights arise under Articles L.217-1 to L.217-32 of the French Consumer Code.

LEGAL GUARANTEE AGAINST HIDDEN DEFECTS

The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code. A claim may be made within two years from discovery of the hidden defect. This guarantee allows the consumer either to retain the product and obtain a reduction in price or to return the product and obtain a full refund.

The legal guarantees apply independently of the voluntary return policy and cannot be excluded or limited by these Terms of Sale.

  1. Consumer mediation

In accordance with Articles L.612-1 and following of the French Consumer Code, if a consumer dispute cannot be resolved after a prior written complaint has been submitted to Commune Des Vagues, the consumer may refer the matter free of charge to:

A mediation request may be submitted online through the mediator’s website or sent by post to the address above. It must be made in writing, in French, and include the relevant supporting documents and evidence of the prior written complaint.

  1. Personal data

Personal data provided during an order is processed to administer payment, fulfil and deliver the order, provide customer service, prevent fraud and comply with legal obligations.

Further information about the purposes, legal bases, recipients, retention periods and customer rights is available in the Privacy Policy. The Privacy Policy does not form part of the sales contract but explains how personal data is handled.

  1. Force majeure

Neither party is liable for a failure or delay caused by an event qualifying as force majeure under applicable French law.

This clause does not limit the consumer’s mandatory rights, including rights relating to non-delivery, reimbursement or legal guarantees.

  1. Applicable law and jurisdiction

These Terms of Sale and the sales contracts governed by them are subject to French law.

If the customer is a consumer residing in another country, this choice of law does not deprive the customer of mandatory protections granted by the law of the country in which the customer habitually resides.

Any dispute may be brought before a court having jurisdiction under the applicable consumer-protection and procedural rules. Nothing in these Terms of Sale imposes exclusive jurisdiction on the French courts where mandatory law gives the consumer the right to bring proceedings elsewhere.

  1. Severability

If any provision of these Terms of Sale is found to be invalid or unenforceable, the remaining provisions continue to apply. The affected provision will be interpreted or replaced only to the extent necessary to comply with applicable law.
